- Our Service Providers, Contractors and Processors: We may disclose or make available personal information to service providers, contractors and processors who perform services on our behalf, such as sending postal mail, email, and text messages, conducting sweepstakes, contests, prize fulfillment and promotional activities, analyzing data, providing marketing assistance, processing credit card payments, providing customer support, and for technical or IT services (e.g., cloud storage).
- Advertising: We partner with advertising companies who may use information from cookies and the tracking tags they place on our websites to provide you with targeted advertisements about goods and services that may be of interest to you based on your use of our websites and to track the effectiveness of ads served to you.
- Ticketing Partners: Your information may be shared with our ticketing partners in order to fulfill your transaction and send you updates, special offers, and other information via electronic messages. - Third Parties With Links From Our Websites: From our websites, you may be able to click on links to third party sites to buy tickets and merchandise and for other purposes. These third party sites may collection information, including personal information. We are not responsible for, nor do we have access to the information they collect. The collection of this information is governed by the privacy policies on the applicable third party sites.
- Social Networking Services: Our websites may integrate with social networking services. We do not control such services and are not liable for the manner in which they operate. While we may provide you with the ability to use such services in connection with our websites, we are doing so merely as an accommodation and, like you, are relying upon those third-party services to operate properly and fairly.
- Co-Branded Pages: We may enter into relationships with “powered by” partners, business partners, sponsors, and co-branded sites (referred to here as “co-branded pages”). These might include, for example, pages that share our name and that of another entity. There may be a specific privacy policy on any such co-branded page. Any personal information that you provide by signing up at any co-branded page may be collected by, or shared with, our third party partner. We have no control over, and are not responsible for, our third party partners’ use of your personal information. D. Retention of Personal Information
We store personal information for as long as necessary to carry out the purposes for which we originally collected it and for other legitimate business purposes, including to meet our legal, regulatory, accounting, or other compliance obligations. Specifically, we will maintain personal information collected about you for as long as we have a relationship with you (e.g., you maintain an account with us or our affiliates and family of companies, purchase tickets, subscribe to communications with us, participate in a financial incentive program, conduct business dealings with us, express interest in our products or services, etc.), or have otherwise not opted-out from other communications with us regarding our products and Services, unless we need to retain the personal information for a longer period of time under the law or for accounting purposes. Please note that after our retention period, we may store information in Non-Personal Information form, as noted above.
II. ADVERTISING AND ANALYTICS
We allow others to provide analytics services and serve advertisements on our behalf across the web and in mobile apps. These entities may use cookies, web beacons, device identifiers, and other technologies to collect information about your use of our Services and other websites and applications, including your IP address, web browser, mobile network information, pages viewed, time spent on pages or in mobile apps, links clicked, and conversion information. This information may be used by us and others to, among other things, analyze and track data, determine the popularity of certain content, deliver advertising and content targeted to your interests on our Services and other websites, and better understand your online activity.
We also work with third parties to serve ads to you as part of customized campaigns on third-party social media platforms. As part of these ad campaigns, we or the third-party platforms may convert information about you into a unique value that can be matched with a user account on these platforms to allow us to learn about your interests and serve you advertising that is customized to your interests. Note that the third-party platforms may offer you choices about whether you see these types of customized ads.
We comply with the Self-Regulatory Principles for Online Behavioral Advertisings set forth by the Digital Advertising Alliance (“DAA”). You can opt-out of targeted advertising from certain providers at www.aboutads.info and www.youronlinechoices.eu. III. TRANSFER OF INFORMATION TO THE UNITED STATES AND OTHER COUNTRIES
We are headquartered in the United States, and we have operations and service providers in the United States and other countries. Therefore, we and our service providers may transfer your personal information to, or store or access it in, jurisdictions that may not provide levels of data protection that are equivalent to those of your home jurisdiction. C. Opt-Out Preference Signals and “Do Not Track” Requests
- We Honor Opt-Out Preference Signals
We honor opt-out preference signals. An opt-out preference signal is a signal that is sent by a platform, technology or mechanism on your behalf that communicates your choice to opt-out of the sharing for targeted advertisements or sale of your personal information. You can learn more about implementing opt-out preference signals at https://globalprivacycontrol.org, or by exploring other developing technologies and services that offer this tool.
We treat opt-out preference signals as valid requests to opt-out of the sale or sharing of your personal information under privacy laws. Ordinarily, your opt-out preference signal is sufficient for us to honor your request, but in some instances we may request additional information to help facilitate your request for offline sales or sharing. We will not use, disclose or retain this additional information for any purpose other than to facilitate the request. If you communicate an opt-out preference signal, we will also display on our website whether we have processed your request by stating “Opt-Out Request Honored.”
- “Do Not Track” Requests
Some browsers have incorporated “Do Not Track” features. Most of these features, when turned on, send a signal or preference to the websites you visit indicating that you do not wish to be tracked. Because there is not yet a common understanding of how to interpret the do not track signal, we currently do not respond to the browser do not track signals. However, as noted above, we do honor opt-out preference signals.
D. Sensitive Personal Information
As noted above, we collect personal information that is considered sensitive under privacy laws. This includes account login information, financial account, debit card, or credit card number, precise and specific geolocation, race, ethnicity, national origin, religious or philosophical beliefs, and email engagement data from tracking pixels. Where required by law, we will obtain your consent before processing your sensitive personal information. We will also only use your sensitive personal information for limited purposes, such as to provide the goods or services you requested; prevent, detect, and investigate security incidents; resist malicious, deceptive, fraudulent, or illegal actions and prosecute those responsible; verify or maintain the quality or safety of a product, service or device; and ensure physical safety of natural persons (“Permitted Purposes”). Because we use your sensitive personal information for Permitted Purposes, we do not currently offer a right to limit use and disclosure of sensitive personal information. E. Your Privacy Rights
Data privacy laws may afford consumers residing in the United States certain rights with respect to their personal information, subject to certain exceptions. If you reside in the United States, this section applies to you. Subject to certain limitations you may have the following rights in the United States:
- (1) Right to Delete. You have the right to request us to delete the personal information we have collected about you.
- (2) Right to Correct. You have the right to request us to correct inaccurate personal information we maintain about you.
- (3) Right to Confirm Processing, Know and Access. You have the right to confirm whether we are processing your personal information and know and access the personal information we have collected about you, including the categories of personal information, the categories of sources from which the personal information is collected, the business or commercial purpose for collecting, selling, or sharing personal information, the categories of personal information and service providers, contractors and third parties to whom we disclosed personal information, and the specific pieces of personal information we have collected about you.
- (4) Right to Data Portability. You have the right to receive the information under right (3) in a format, to the extent technically feasible, that is portable, usable, and allows you to transmit the personal information to a person without impediment or hindrance.
- (5) List of Specific Third Parties: You have the right to receive a list of specific third parties to which we have disclosed or sold your personal information, if we maintain that information in a format specific to you. If we do not maintain that information specific to you, we will provide a list of specific third parties to whom we have disclosed or sold any consumers’ personal information.
- (6) Rights Related to Automated Decisionmaking Technology (“ADMT”) and Profiling. Data privacy laws may provide various rights, including opting-out, contesting and accessing information, related to the use of ADMT and processing of your personal information for profiling in furtherance of decisions that produce legal or similarly significant effects. However, please note that we will not use such ADMT and profiling to make decisions that produce legal or similarly significant effects, such as decisions that result in the provision or denial of financial or lending services, housing, insurance, education enrollment or opportunities, criminal justice, employment or independent contracting opportunities or compensation, health care services, or access to essential goods or services or basic necessities As such, these rights are not offered.
- (7) Rights Related to Sharing for Targeted Advertising or Sale. You have the right to opt out of the sharing of your personal information for targeted advertising or the sale of your personal information.
- (8) Rights Related to Sensitive Personal Information or Data. Data privacy laws may provide additional protection for sensitive personal information or data. Please see Sensitive Personal Information in Section VI.D above for more information.
- (9) Right to No Discrimination. You have the right not to be discriminated against for exercising any of your privacy rights. We provide perks like free or discounted tickets, exclusive events and amenities, unique collectibles, and other perks for customers who participate in our financial incentive and bona fide loyalty programs, including Audience Rewards, President’s Club, season ticket subscriptions, theater memberships, our theaters’ Lotteries, and exclusive access through brands. Other programs may be listed in the program offerings. Through these offerings, consumers may provide us personal information, such as name, email address, and zip code, when they opt-in. There is no obligation to opt-in and consumers may opt-out at any time. We offer these programs for marketing and advertising purposes, to learn more about our customers, to enhance and improve our services and for other reasons that may be disclosed in the program offerings. We invest in our marketing and brands, in part, so we can provide programs to our customers.
